Terms of Service

1. Agreeing to these terms

By creating an account or using AgentOp, you agree to these terms. If you are using the service for an organisation, you confirm you are authorised to accept these terms on its behalf.

You must be at least 16 years old to hold an account.

We record which version of these terms you accepted when you signed up. If we make a material change, we will ask you to accept the new version and will give reasonable notice first. Continuing to use the service after a change takes effect means you accept it.

2. What the service actually is

This section is not marketing. It determines who is responsible for what, so it is worth being precise.

• AgentOp is a builder and a directory. It generates a self-contained HTML file from a template you chose and code you control.
• We do not run the model. With a local model, your browser downloads model weights directly from a third-party host and runs them on your own hardware. With OpenAI or Anthropic, your browser talks to that provider directly using your own API key.
• The standard runtime does not send ordinary conversations to AgentOp. If you save evaluation tests, their inputs and submitted outputs are stored on our servers. Submitted feedback and saved agent or template code can also contain information you choose to share. Community templates can add external requests of their own.
• The optional sponsored generation feature, where a request does run on our infrastructure using our key. Section 8 covers it.
• A downloaded agent is a file you keep. We cannot recall that file. Local inference can work offline once its required models and runtime assets are available. Cloud inference needs a connection; agents can also fetch runtime assets and refresh the model list from our servers.

3. Your account

You are responsible for keeping your credentials secure and for everything done through your account. Tell us promptly if you believe it has been compromised. Provide accurate registration information and keep your email address current — account recovery depends on it.

One person or organisation per account. Do not share an account, and do not create accounts to evade a suspension or to obtain additional sponsored generations.

4. Acceptable use

These rules are about conduct and outcomes, not about which model you chose. Some models offered here have had their refusal behaviour reduced or removed; that is a property of a tool, and the tool has legitimate uses. What follows applies identically whichever model, provider or template you use.

You may not use AgentOp, or publish an agent or template here, to do or enable any of the following:

Because agents run on your own device, we cannot technically prevent any of this — and we are not claiming to. What we can do is decline to host it, decline to distribute it through the marketplace, and close the account behind it. That is what section 9 describes.

5. Your content, and what you let us do with it

You keep ownership of the agents, templates, code, prompts and descriptions you create. We claim no ownership over them.

When you publish something — make an agent public, publish a template to the marketplace — you grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute it for the purpose of operating and promoting the service. That includes showing it in listings, search results, the Spotlight strip and social preview images, and allowing other users to run it and, where you permit forking, to build on it. The licence lasts as long as you keep the content published, and ends when you unpublish or delete it — except for copies other users have already downloaded or forked, which we cannot recall.

Anything you keep private stays private. We do not use private agents for promotion, and we do not train anything on your content.

You confirm that you have the rights to everything you publish, and that publishing it does not infringe anyone else's rights.

6. Model output is not a fact

Language models produce plausible text, including when they are wrong. Output from an agent built here may be inaccurate, incomplete, biased, offensive or entirely fabricated, and small models running on your own device are more prone to this than large hosted ones.

You are responsible for verifying anything you rely on, and for any decision you take on the basis of it. Do not use an agent's output as a substitute for professional medical, legal or financial advice. If you publish an agent that others will use, you are responsible for how you describe what it can do.

We do not review, endorse or verify agents published by other users. A listing in the marketplace is not a recommendation, and a curated Spotlight placement is an editorial choice about presentation, not a warranty of quality or safety.

7. Third parties you also have an agreement with

Running an agent usually involves someone other than us, and their terms apply to you directly:

• Model hosts. Local model weights are downloaded by your browser from third-party hosts such as Hugging Face, under whatever licence the model publisher set. Model licences vary and some restrict commercial use. Check the licence of any model you rely on.
• API providers. If you supply an OpenAI or Anthropic key, your use of their models is governed by your agreement with them, including their own usage policies. We are not a party to it.
• Availability. If a third-party host removes a model or a provider retires an API, agents depending on it may stop working. We will mitigate where we reasonably can, but we do not control it.

8. Sponsored generation

The optional sponsored tier lets you generate a limited number of templates per day using our API key, at our cost. Those generation requests run through our servers and are subject to per-account, per-IP and global daily limits.

Because we pay for it, we keep an audit record of each sponsored call — see the Privacy Policy for exactly what that record contains. Attempting to circumvent the quota, or reselling access to it, is a breach of section 4. The feature is free, and we may change, limit or withdraw it at any time.

9. Removal, suspension and termination

We may remove or unpublish any agent, template, rating, collection or other content, and may suspend or close an account, where we reasonably believe it breaches these terms — in particular section 4 — or where we are legally required to.

Where circumstances allow, we will tell you what was removed and why, and give you a way to respond. For serious cases — material that is illegal, or conduct that puts other users at risk — we may act immediately and explain afterwards.

You can leave at any time. Contact us to request account deletion; there is currently no self-service deletion screen. Deletion removes your published content from the service. Copies already downloaded or forked by other users are outside our control, as described in section 2.

10. Reporting content

If something published here infringes your rights, breaches section 4, or is otherwise unlawful, email the operator's public community channel with a link to the content, a description of the problem and how to reach you. For a copyright claim, include enough detail to identify the original work and confirm that you are the rights holder or are authorised to act for them.

We investigate reports and act on the ones we can verify. We may pass a report on to the user who published the content so they can respond.

11. Service availability

We aim to keep the service running but do not guarantee uninterrupted availability. We may change, suspend or discontinue features, including free ones, and may impose limits where needed to keep the service viable. We will give reasonable notice of a material reduction where we practically can.

You keep files you have already downloaded. Their continued operation depends on your browser, available runtime assets and models, and any external APIs or other services they use. Downloading does not guarantee future availability of those dependencies.

12. No warranty

Please read this section and the next one carefully.

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted operation.

In particular, we do not warrant that the service will meet your requirements, that any agent will work on your hardware, that model output will be accurate or suitable for any purpose, or that any defect will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, this section applies to the fullest extent permitted, and nothing here limits rights you have as a consumer that cannot be waived by agreement.

13. Limitation of liability

To the fullest extent permitted by law, AgentOp will not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of the service — whether or not we were advised that such damages were possible.

Our total aggregate liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred euros.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Where a jurisdiction does not permit these limits, they apply to the maximum extent it does permit.

14. Indemnity

You agree to indemnify and hold harmless AgentOp against claims, damages, losses and reasonable legal costs arising from content you publish, from your use of the service in breach of these terms, or from your violation of another person's rights. We will notify you of any such claim and will not settle it without your consent, which you will not unreasonably withhold.

15. Changes to these terms

We may update these terms. The version string and date at the top of this page always identify the current document. For material changes we will notify account holders by email or in the application before the change takes effect, and ask you to accept the new version.

16. General

If any provision of these terms is found unenforceable, the rest remain in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or sale of assets.

These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the service.
